The Wisconsin Technical College System provides the WTCS CurriculumBank website under an agreement with the Wisconsin Technical College System Foundation, Inc. and Yahara Software, for educational and informational purposes.  Your access to and use of this website is subject to the following terms and conditions of use, as well as all applicable laws.  By accessing, browsing, using or posting to the website, you agree that you accept, without limitation or qualification, the following terms and conditions of use, and any applicable laws.

1.  You are entirely responsible for maintaining the confidentiality of your personal information as posted in any of our public forum areas (discussion areas, curriculum listing sites, etc.).

2.  You are responsible for all activities associated with your use of the forum areas, including all materials (information, communications, text, graphics, links, courses, files, or other data) posted to the website. 

3.  By uploading or otherwise making available information, data, or communications to the website, you automatically grant and/or warrant that the owner of said information, data, or communication has granted the Wisconsin Technical College System the right to publish, distribute and/or otherwise transmit said information, data, or communication through the website, and the royalty-free, non-exclusive right to use, reproduce, modify, publish, distribute, perform, and/or display said material through the website.

You also permit any other user of the website, subject to your restrictions, to access, view, and/or store data and/or communications you post to the website.  Moreover, you acknowledge that any content that is on or otherwise contained in the website that is not made available by you is not yours, and you do not have ownership's rights to that content.  Therefore, you may not copy, publish, reproduce, use, modify, or distribute said content, without the express written permission of the owner, or in violation of U.S. laws (said laws relating to copyright, trade secrets, and/or any other statutory or regulatory provisions).

4.  You agree to access and use website only for lawful purposes.  You are solely responsible for the knowledge of and adherence to all laws, statutes, rules, regulations and restrictions pertaining to your use of the website.   By accessing and using the website, you agree that you will:

• not post or transmit any unlawful, threatening, libelous, harassing, defamatory, vulgar, obscene, pornographic, profane, or otherwise objectionable content;
• not alter, damage or delete any content or other communications that are not your own content or to otherwise interfere with the ability of others to access the website; 
• not disrupt the normal flow of communication in any interactive website areas not claim a relationship or affiliation with, or speak for, any business, person, association, organization or institution for which or whom you are not authorized to claim such a relationship; not post or transmit any unsolicited advertising, promotional materials, or other forms of solicitation to other users. 

5.  The only right with respect to dissatisfaction with any policies, guidelines, or practices with the website, or any content therein, is for you to discontinue accessing the website. the Wisconsin Technical College System or the Wisconsin Technical College System Foundation, Inc. in its discretion, may terminate or temporarily suspend your access to all or any part of the website, without notice, for conduct that either believes is in violation of this agreement, or any policies or guidelines posted by the Wisconsin Technical College System and/or the Wisconsin Technical College System Foundation for other conduct which in the discretion of either, it believes is harmful to other users.

The Wisconsin Technical College System and/or the Wisconsin Technical College System Foundation, Inc. may discontinue the website and terminate this Agreement without notice at any time for any reason.

6.  DISCLAIMER OF WARRANTY. Neither the Wisconsin Technical College System nor the Wisconsin Technical College System Foundation is responsible for any information or content contained in its interactive areas, other than those posted by active employees of the Wisconsin Technical College System or the Wisconsin Technical College System Foundation, Inc., and neither makes representations about the suitability of the information contained in the interactive areas for any purpose, or about its legitimacy, legality, validity, accuracy, correctness, reliability, quality, stability, completeness, currency, or copyright status.

You agree that your use of the website, including interactive areas, is at your own risk.  The Wisconsin Technical College System, the Wisconsin Technical College System Foundation, Inc. (its officers, directors, employees, affiliates, or agents) and Yahara Software, do not warrant that the website will be uninterrupted or error-free, nor do they make any warranty as to the results that may be obtained from the use of any website, downloadable products, or as to the accuracy, reliability, or content of the website.

Materials on this website are presented on "as is" and "as available" basis without representations or warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event will the Wisconsin Technical College System, the Wisconsin Technical College System Foundation, Inc. (its directors, officers, employees, affiliates or agents), or Yahara Software be liable to you or any third party for any incidental, indirect, special or consequential damages (even if the aforementioned parties have been advised of the possibility of such damages) arising out of your use of, or inability to use, any function of the website and/or downloadable products.  This includes, without limitation, loss of revenue or anticipated profits, loss of goodwill, lost business, lost data, computer failure or malfunction, or any and all other damages or losses that result from mistakes, omissions, interruptions, deletions of files, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to any of website, records, programs or services.  Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states the liability of the Wisconsin Technical College System, the Wisconsin Technical College System Foundation, Inc. and Yahara Software is limited to the greatest extent permitted in sections 2 and 3.

Links:  Some links on the website lead to sites posted independently of the Wisconsin Technical College System, the Wisconsin Technical College System Foundation, Inc., and Yahara Software.  The aforementioned parties do not review independent sites, nor do they control their content. They merely provide these links to visitors for their convenience.  These links are not an endorsement of the products, services, or information provided by such sites.  Further, the inclusion of these links to other sites does not imply that the other sites have given permission for inclusion of these links, or that there is any relationship between the aforementioned parties and the linked sites. 

The Wisconsin Technical College System Foundation, Inc. is an independent, not-for-profit corporation and reference to other companies, services or products does not imply any partnership, joint venture, or other legal connection in which the Wisconsin Technical College System Foundation, Inc. would be responsible for the actions of the sites' respective owners.
